सभी को समान अधिकार देना है। 27 जनवरी का दिन समान नागरिकता दिवस के रूप में मनाया जायेगा। CM धामी ने कहा कि UCC लागू होने से हलाला, बहुविवाह एवं तीन तलाक पर पूरी तरह से रोक लग जायेगी। नागरिक संहिता उत्तराखंड-2004 को लागू किये जाने को लेकर एक पोर्टल आम जनता के लिये खोल दिया गया है। UCC लागू करने वाला देश का पहला राज्य बना उत्तराखंड बन गया है। CM धामी ने कहा कि समान नागरिक संहिता लागू होने से समाज में एकरूपता आयेगी।
CM Dhami stated that the implementation of UCC will completely ban practices like halala, polygamy, and triple talaq. A portal has also been launched for the general public regarding the enforcement of the "Civil Code Uttarakhand-2004." Uttarakhand has become the first state in the country to implement the UCC. The CM mentioned that this will bring uniformity in society, ensuring equal rights and responsibilities for all citizens. The law has officially come into effect from today.
3. Equal Grounds for Divorce: Divorce will only be granted when both husband and wife provide the same grounds and reasons. Divorce will not be granted based on reasons provided by only one party.
5. Responsibility for Children Born in Live-In Relationships: If a child is born out of a live-in relationship, both partners will be responsible for the child. They will also be required to give the child their name, ensuring every child in the state gets recognition.
राज्य में सभी नागरिकों के लिए समान अधिकार होंगे और दायित्व भी तय हो सकेंगे। आज से यह कानून प्रभावी हो गया है। राज्य के DGP बोले हम नये कानून UCC को लागू करने के लिये पूरी तरह से तैयार हैं।
आगे क्या होगा… जानें
समान संपत्ति अधिकार: बेटा और बेटी दोनों को संपत्ति में समान अधिकार मिलेगा। इससे फर्क नहीं पड़ेगा कि वह किस कैटेगरी के हैं।
मौत के बाद संपत्ति: अगर किसी व्यक्ति की मौत हो जाती है तो यूनिफॉर्म सिविल कोड उस व्यक्ति की संपत्ति को पति या पत्नी और बच्चों में समान रूप से वितरण का अधिकार देता है। वहीं, उस व्यक्ति के माता-पिता को भी संपत्ति में समान अधिकार मिलेगा। पिछले कानून में ये अधिकार केवल मृतक की मां को मिलता था।
समान कारण पर ही मिलेगा तलाक: पति-पत्नी को तलाक तभी मिलेगा, जब दोनों के आधार और कारण एक जैसे होंगे। केवल एक पक्ष के कारण देने पर तलाक नहीं मिल सकेगा।
लिव इन का रजिस्ट्रेशन जरूरी: उत्तराखंड में रहने वाले कपल अगर लिव इन में रह रहे हैं तो उन्हें इसका रजिस्ट्रेशन कराना होगा। हालांकि ये सेल्फ डिक्लेरेशन जैसा होगा, लेकिन इस नियम से अनुसूचित जनजाति के लोगों को छूट होगी।
संतान की जिम्मेदारी: यदि लिव इन रिलेशनशिप से कोई बच्चा पैदा होता है तो उसकी जिम्मेदारी लिव इन में रहने वाले कपल की होगी। दोनों को उस बच्चे को अपना नाम भी देना होगा। इससे राज्य में हर बच्चे को पहचान मिलेगी।
"Ban on Multiple Marriages: Uttarakhand Becomes the First State to Implement UCC"
The Uniform Civil Code (UCC) has been implemented in Uttarakhand from today, as announced by Chief Minister Pushkar Singh Dhami. Speaking at a program held at the Mukhyasevak Sadan of the CM's residence, CM Dhami stated that a promise made to the public three years ago has been fulfilled. He emphasized that the UCC is not against any religion or community, nor is it intended to target anyone. Its aim is to ensure equal rights for everyone. January 27 will be celebrated as Uniform Civil Code Day.
The state’s DGP has stated that they are fully prepared to enforce the new UCC law.
What Will Change?
1. Equal Property Rights: Sons and daughters will have equal rights to inherit property, irrespective of their category or status.
2. Property Distribution After Death: If a person dies, the Uniform Civil Code will ensure equal distribution of the deceased’s property among the spouse, children, and parents. Previously, this right was only given to the deceased's mother.
4. Mandatory Registration for Live-In Relationships: Couples living in live-in relationships in Uttarakhand will now need to register their relationship. This registration will be similar to self-declaration. However, Scheduled Tribes will be exempt from this rule.
